Dit voorstel regelt zeggenschap, beheer, gebruik en toezicht rond lichaamsmateriaal buiten behandeling of diagnostiek van de donor.

Relevant voor zorginstellingen, biobanken, onderzoekers, gebruikers van lichaamsmateriaal en donoren. Praktijkjuristen moeten letten op toestemming, informatieplichten, toetsing en handhaving.

Kern van het voorstel
  • Toestemming is hoofdregel voor afnemen, bewaren en gebruiken van lichaamsmateriaal.
  • Beheerders krijgen informatie-, meld-, beheerreglement-, registratie- en vernietigingsplichten.
  • Uitzonderingen gelden voor kwaliteitsbewaking, bepaald algemeenbelangonderzoek, niet-herleidbaar wetenschappelijk onderwijs en strafvordering.
  • Speciaal afnemen en wetenschappelijk gebruik vergen protocoltoetsing door een erkende commissie.
Belangrijkste bepalingen
Inwerkingtreding
De wet treedt in werking op een bij koninklijk besluit te bepalen tijdstip, eventueel verschillend per artikel of onderdeel.
Overgangsrecht
Voor vóór inwerkingtreding afgenomen lichaamsmateriaal gelden aangepaste toestemmingsregels en uitzonderingen, inclusief voorwaarden voor sensitieve toepassingen zonder toestemming.
