Voorstel van wet van het lid Rooderkerk tot wijziging van de Leerplichtwet 1969, de Leerplichtwet BES, de Wet op het primair onderwijs, de Wet primair onderwijs BES, de Wet op de expertisecentra en de Wet voortgezet onderwijs 2020 en enkele andere wetten in verband met de verankering van het leerrecht

Relevant voor scholen, samenwerkingsverbanden, gemeenten, leerambtenaren, jeugdartsen, ouders en leerlingen. Praktisch belangrijk bij toelating, thuiszitters, vrijstellingen, maatwerkprogramma’s en onderwijs-zorgarrangementen.

• Leerrecht wordt wettelijk recht op onderwijs gericht op volledige ontplooiing van het kind.
• Toelating wordt hoofdregel; weigering mag alleen op limitatieve wettelijke uitzonderingsgronden.
• Leerplicht wordt deelname aan aangeboden onderwijs, niet langer geregeld schoolbezoek.
• Leerambtenaar krijgt aanwijzingsbevoegdheid en gemeenten kunnen bestuurlijke boetes opleggen.

Inwerkingtreding

De wet treedt in werking op 1 augustus van het jaar na plaatsing in het Staatsblad.

Overgangsrecht

Bestaande vrijstellingen blijven ongemoeid; bij nieuwe jaarlijkse aanvragen geldt de procedure van de Leerwet.
