Wat dit wetsvoorstel doet

De wet maakt handhaving in de sociale zekerheid menselijker en evenrediger, met meer ruimte voor waarschuwingen, maatwerk en bescherming tegen terugvordering.

Wie het raakt

Mensen met een uitkering, toeslag, kinderbijslag of voorziening binnen de sociale zekerheid worden geraakt. Ook uitvoeringsorganisaties en gemeenten die die uitkeringen beheren en handhaven krijgen nieuwe beoordelingsruimte en verplichtingen.

Kern van het voorstel
  • Bestuursorganen moeten mensen na een overtreding begrijpelijk informeren over de geldende verplichtingen.
  • Bij boetes en maatregelen gelden wettelijke afwegingsfactoren: ernst, verwijtbaarheid en rol van het bestuursorgaan.
  • Terugvordering wordt begrensd, met bescherming tegen fouten of traag handelen van de overheid en een vijfjaarstermijn.
  • Kwijtschelding wordt verruimd; bij schending van de inlichtingenplicht geldt voortaan een vijfjaarstermijn.
Belangrijkste bepalingen
Inwerkingtreding
Deze wet treedt in werking op een bij koninklijk besluit te bepalen tijdstip, dat per artikel of onderdeel kan verschillen.
Overgangsrecht
Op besluiten die vóór inwerkingtreding zijn genomen op basis van gewijzigde of vervallen artikelen blijft het oude recht van toepassing.
Samenhang met
Bij samenloop met onderdelen van de Participatiewet in balans wordt deze wet op meerdere punten aangepast volgens artikel XVIIIA.
